TERMS OF SALE
(applicable to both direct and auction sales)
The following are the terms and conditions for all sales unless otherwise specified in writing by an authorized representative of Hendrick Honda
PAYMENT METHODS
Cash, Certified Checks, and direct wire transfers are the only acceptable form of payment unless otherwise specified by an authorized representative. Financing may be available on some vehicles and is to be approved prior to acceptance of any bidding on auctions. Please contact us for details of finance programs available and to apply. Please have all funds available for payment in full within the 5 day period after end of auction and/or have financing secured before final bid or contact us to make other arrangements. If another form of payment is accepted by an authorized representative, the vehicle will only be released for delivery and/or shipping upon proof of valid and cleared funds in Hendrick Honda account.
DEPOSITS:
All vehicles remain available for sale until full payment or agreed upon deposit is received by Hendrick Honda. Vehicles purchased through EBAY auction are required that the deposit be received within 24 hours of the end of the auction or the car will be re-listed and available for sale. When a deposit is received , the vehicle is taken off the market and other buyers may be lost. All deposits are only refundable at the seller’s discretion. Please do not bid or place a deposit on any vehicle unless you fully intend to purchase the car!
REMAINING BALANCES DUE:
The buyer agrees to pay remaining balance due including all applicable taxes and fees within 5 days of the purchase date or end of EBAY auction unless other arrangements are made with us in advance. This includes the completion of any finance contracts necessary for Hendrick Honda to be funded in full for the vehicle purchase unless agreed upon by an authorized representative. All financial transactions are to be complete and Hendrick Honda fully funded before delivery and/or transportation of vehicle.
ADDITIONAL TAXES AND FEES:
We do charge a $399.00 documentation fee on each retail sale which includes a temporary tag when applicable, motor vehicle documents and transfers and miscellaneous expenses including clerical fees, notary fees and Federal Express and US mail charges. This fee cannot be discounted or waived under any circumstance. We are a licensed dealer in North and South Carolina and will collect Sales Taxes for those two states. For any other state the buyer will be responsible for all state, county and local taxes and fees as well as any registration and title fees applicable in and required by the state in which the buyer will register and title the vehicle. Buyer is responsible for any expenses , tax and fees should they export the car outside of the US.
SHIPPING:
We can usually ship the vehicles purchased at a discounted rate by using our transporters usually bringing the vehicle right to your front door. Please contact me for a quote and the availability of shipping to your destination. Hendrick Honda will also happy to assist buyer with transportation arrangements within the United States borders to assist our customers. The buyer is responsible for all shipping charges and are generally paid COD, directly to the shipping company when the car arrives, or is included in the total amount due to us in the transaction if being shipped using our transporters. Hendrick Honda assumes no responsibility for damages incurred after the vehicle leaves our premises unless damage is caused by neglect of our drivers. Hendrick Honda can not be held responsible for any delays in shipping as it is beyond our control. We will do our best in estimating shipping dates and times to make the delivery as timely and smooth as possible. Hendrick Honda will NOT handle any arrangements for export outside the United States . It is the purchaser’s sole responsibility to handle all related details and transport of any vehicle to be exported. Hendrick Honda in no way represents or implies as to any vehicles legal ability to be exported outside of the US.
Should you decide to come to our Charlotte location for delivery, we would be happy to help with your transportation arrangements and also arrange to pick you up at Charlotte-Douglas International Airport.
WARRANTY:
This vehicle is being sold as is, where is, with no warranty, expressed written or implied unless otherwise stated in the auction. No allowance or set aside will be made on account of any incorrectness, imperfection, defect or damage. Any descriptions or representations are for identification purposes only and are not to be construed as a warranty of any type. It is the responsibility of the buyer to have thoroughly inspected the vehicle, and to have satisfied himself or herself as to the condition and value and to bid based upon that judgment solely. The seller shall and will make every reasonable effort to disclose any known defects associated with this vehicle at the buyer's request prior to the close of sale. Seller makes no guarantee or warranty, expressed, written or implied of the vehicles ability to pass any state emissions inspection. In the event a vehicle fails state emissions inspection, Hendrick Honda bears no responsibility whatsoever. Remaining manufacturers warranty if applicable may apply.
VEHICLE INSPECTION:
Hendrick Honda and it's representatives have made every effort to accurately and fairly describe the vehicle to you and disclose any known information regarding the vehicle. We will never describe a car as "perfect" and buyer should have expectations of "typical" dings and or chips and scratches that are consistent with the year and mileage on the vehicle. Buyers are provided with all additional items that were provided to us with the vehicle. Buyers are to expect that NOT all used vehicles will be provided with full sets of keys, books, CD magazines, Navigation Discs, floor mats or the like NOR will all cars be accompanied by detailed service records etc. Hendrick Honda will not be held responsible to provide any additional items other than represented as with the car unless detailed in writing by an authorized representative. Hendrick Honda welcomes an independent inspection of the vehicle prior to purchase. All costs and arrangements for such inspections are the responsibility of the buyer. If bidding on vehicle in an EBAY auction please make arrangements for inspections prior to end of auction. All inspections are to be performed on premises at Hendrick Honda showroom or at a local shop in our area. Please call if you need recommendations of inspection services available in Charlotte. Hendrick Honda will review any issues or concerns that develop as a result of an inspection and will make repairs , adjustments or concessions at their sole discretion.
NOTICE TO EBAY AUCTION BIDDERS:
Please do not bid on our auctions unless you are able and willing to complete the transaction should you be the winning bidder. By bidding and winning the auction you are entering in to a legally binding contract for the purchase of that particular vehicle according to your User agreement with EBAY. We reserve the right to cancel all bids and end an auction early should the vehicle no longer be available for sale.
BID RETRACTIONS:
Bid's are not retractable except for exceptional circumstance according to your user agreement with EBAY (see EBAY user agreement for specific details) Seller will not allow or recognize retracted bids within the last 24 hours of the auction. Seller is not obligated to sell if there are retractions in the last 24 hours and reserve the right to cancel all bids and re-list the auction. This retains the integrity of the auction and makes it fair to serious bidders.
PLEASE DO NOT HIT THE "BUY IT NOW" UNLESS YOU INTEND ON PURCHASING THE VEHICLE FOR THE "BUY IT NOW" PRICE. WE DO NOT RECOGNIZE ANY EXCUSE FOR HITTING THE BUY IT NOW IN ERROR AND WILL HOLD THE EBAY ACCOUNT HOLDER LIABLE FOR ANY COSTS INVOLVED FOR LISTING AND RE-LISTING OF THE AUCTION IF YOU DO NOT COMPLETE THE PURCHASE.
NEGATIVE or ZERO FEEDBACK BIDDERS:
We do not allow bidding from negative feedback bidders. Zero feedback or new members MUST contact us prior to bidding by either e-mail or telephone prior to placing a bid on our vehicles. If you are new to EBAY or have a Zero feedback, please contact us with your name and contact information to verify your identity and that you are serious about completing your purchase. Seller reserves the right to cancel any bids from a negative bidder or a zero bidder if they do not contact us prior to bidding.
WINNING BIDDER:
You will be contacted shortly after the close of the auction by e-mail. Winning bidder is required to contact seller within 24 hours to provide necessary billing information and required documents and to make payment and delivery arrangements. If you do not contact us within 24 hours we reserve the right to re-list the auction and make the car available for sale.
NON PAYING BIDDERS:
If deposit is not received within 24 hours and final payment within 7 days, buyer will be consider a non payer and seller reserves the right to re-list the auction and make the vehicle available for sale to other buyers. Non paying bidders may be subject to negative feedback. Non paying bidders will be held liable for costs for re-listing the vehicle auction.>
