Sale
The
following terms of sale apply to all of our online sales.
Payment
Methods
Cash in person (COD),
certified check, bank wire transfer, or 3rd-party financing. All funds must be in US dollars only. All funds must clear before vehicles are
released. Please be sure to have full payment and/or approved financing in
place before making your final bid. Call
us for more information.
Deposit
The
successful high bidder will submit a 25% non-refundable deposit within 3
business days of the close of the auction to secure the vehicle.
Payment
of Balance Due
The
buyer agrees to pay remaining balance due (plus applicable fees and taxes)
within 7 days of the close of the auction. All financial transactions must be
completed before delivery of the vehicle.
Additional
Fees and Taxes
Buyer
pays all taxes. Outs of state buyers are responsible for all state, county,
city taxes and fees, as well as title/registration fees in the state that the
vehicle will be registered.
Note:
When
you place a bid on a vehicle, you are entering into a legal and binding
contract to purchase the vehicle conditioned only upon being the highest

Seller
reserves the right to cancel any and all bids, or end the auction early at its
sole and complete discretion before the close of the auction.
Those
with significant (in seller’s opinion) negative feedback or any bid retractions
must contact seller prior to bidding to obtain approval to bid or they have
their bids rejected or canceled before or after the end of the auction.
Bidder
must be 18 years or older. Bid retractions are not allowed and will not be
recognized within 24 hours of auctions end. High bidder must contact the seller
within 24 hours of the auction ending to make arrangements to complete their
transaction.
If,
within seven (7) calendar days of the auction end all moneys are not received
then buyer shall, at sellers option, be liable for
sellers actual damages or forfeit the deposit as liquidated damages.
Seller
welcomes buyers pre-bid inspection at seller’s place of business but any such
inspections must be completed prior to the auction ending, during regular
business hours and shall be at buyers cost.
The
vehicle is a used vehicle and has wear and tear and other faults that may not
be readily apparent or may appear instantaneously. Our goal is to continue providing
accurate descriptions. It is important to recognize that the vehicles we list
are pre-owned. As a result there can be
additional minor wear that should be expected such as minor scratches, small
nicks and minor blemishes. These imperfections will not detract from the overall
appearance and value of the vehicle.
Accessories such as cigarette lighters, manuals, floor mats, remotes and CD
magazines may also be missing.
To
the best of our knowledge we have identified any mechanical problems that are
present in the description above. However, we are selling the vehicle "as
is", without warranty unless the vehicle has a remaining factory warranty,
otherwise, the vehicle is being offered as is where is with any and all faults.
Seller expressly disclaims all warranties, either express
or implied, including any implied warranties of
merchantability or fitness for a particular purpose and neither assumes nor
authorizes any person to act for it regarding any liability in connection with
the sale of the vehicle.
Manufacturer
warranties may still apply. Extended warranties may be available. Please
contact us for details.
Any
controversy or claim arising out of or related to the placement and/or
acceptance of a bid and/or the purchase and sale of the vehicle on which the
bid is placed shall be governed by Pennsylvania law and the buyer and seller
agree to submit same to binding arbitration in the City of West Chester,
Commonwealth of Pennsylvania in accordance with the rules of commercial
arbitration of the American Arbitration Association in front of three arbitrators.
One selected by the seller, one by the buyer and one by the two selected arbitrators sitting in judgement. Any court having jurisdiction may enter judgment upon
the award rendered by the Arbitrator.
Seller
reserves the right to cancel the sale if, in seller’s sole opinion, the buyer
is unreasonable or abusive. Seller will warn buyer only once that their
behavior, actions or positions are perceived by seller to be unreasonable or
abusive prior to canceling the transaction. If seller cancels the transaction
due to buyer being unreasonable or abusive seller will refund any deposit or
payment made by buyer but no other costs incurred by buyer of any kind.
Titles
and ownership’s - Title delivery can take up to 30 days from the date of final
payment. Final payment date is the date that the funds clear our bank.
If
you do not accept all of the above conditions and rules then do not bid on this
auction.
